Terms of Service

These terms are an agreement between you and cutefatboy LLC, which runs Visual Novel AI at visualnovelai.com. By creating an account or using the site, you agree to them, to our Privacy Policy, and to our Refund Policy.

1. Who can use it

You must be 18 or older. One person per account. Keep access to your sign-in email secure; you're responsible for what happens on your account.

2. The characters are AI

All character dialogue and narration is written by AI as you play. Characters aren't real people, and what they say can be wrong, inconsistent, or unexpected. Nothing a character says is professional advice (medical, legal, financial, or mental health), so don't rely on it for real decisions.

3. Safety and crisis support

Messages and replies are screened automatically. If a message suggests someone may be thinking about suicide or self-harm, the story pauses and shows crisis resources, such as the 988 Suicide & Crisis Lifeline (call or text 988 in the US), and you choose when to continue. If you or someone else is in immediate danger, contact local emergency services.

4. Acceptable use

Stories here are PG-13. Don't use Visual Novel AI to:

• create sexual content, or anything that sexualizes minors or characters presented as minors (zero tolerance)
• harass, threaten, or demean anyone, or promote hate
• encourage self-harm, violence, or illegal activity
• share other people's private information
• get around moderation, or try to extract our prompts or system instructions
• access the service with bots, scrapers, or scripts, overload it, or reverse-engineer it
• resell access or impersonate someone else

If you break these rules, we may warn you, pause your messages for a while, remove content, or suspend or close your account. We may report serious cases to the authorities.

5. Your content

You own what you write: your messages, profile, and memories. You let us store, process, and display it, and share it with our service providers, to run, moderate, and improve Visual Novel AI as described in the Privacy Policy. You're responsible for what you write and must have the right to share it.

6. Our content

The stories, characters, artwork, and software belong to us or our licensors. You may use your conversations for personal, non-commercial purposes, like sharing screenshots. You may not use our characters or art commercially or to train AI models. Replies are generated fresh, and other players may get similar ones.

7. Plans and usage

• Free includes 50 messages. Plus and Pro are subscriptions, billed monthly or yearly through Stripe, that renew until you cancel. Cancel anytime from your account; your plan stays until the end of the period you've paid for.
• Plus includes a set amount of usage each month. When it runs out, messages pause until it resets, or until you top up or upgrade.
• Pro's unlimited messages are for personal play by one person (fair use). We may limit accounts that use automation, are shared, or use far more than normal play, and we'll contact you first where we can.
• Top-ups (Plus and Pro) are prepaid usage for new expressions, and for messages once Plus's monthly usage runs out. They don't expire, have no cash value, and can't be transferred, except for refunds under the Refund Policy.
• Upgrades start right away and are charged the prorated difference. Downgrades start at your next renewal.
• Usage spent on a generation that fails is returned automatically.
• We may change prices or what plans include. A new subscription price applies from your first renewal after we tell you.
• Deleting your account cancels your subscription and deletes unused top-ups. If we close your account when you haven't broken these terms, or shut down Visual Novel AI, we'll refund unused top-ups and the unused part of your subscription.

8. Changes and availability

Visual Novel AI is new and changes often. We may add, change, or remove features and stories, and the service may sometimes be unavailable.

9. Ending your account

You can delete your account at any time from the profile page. We may suspend or close accounts that break these terms or put others at risk. Accounts unused for 6 months are deleted as described in the Privacy Policy.

10. Disclaimers

Visual Novel AI is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and the accuracy of AI-generated content.

11. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not apply to you.

12. Indemnity

If a claim against us is caused by your content or by your breaking these terms, you agree to cover our reasonable losses and costs from it.

13. Disputes

Please contact us first at support@visualnovelai.com; we'll try to resolve any issue within 30 days. These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes go to the state or federal courts located in Texas, and either of us may use small claims court instead.

14. Changes to these terms

We'll post changes here and update the date above. For significant changes, we'll tell you in the app or by email at least 14 days before they take effect. Using Visual Novel AI after that means you accept them.

15. General

These terms, the Privacy Policy, and the Refund Policy are the whole agreement between us. If part of them can't be enforced, the rest still applies. Not enforcing a term isn't a waiver. You can't transfer these terms; we may transfer them as part of a merger or sale of the business.
